1. Heard learned counsel for petitioner and learned
State counsel for opposite party.

2. Petition has been filed seeking a direction to concerned authority for payment of gratuity alongwith interest to petitioner in view of his superannuation from service on 30.09.2001.

3. Learned State counsel has been provided written
instructions dated 19.11.2025, a copy of which is
taken on record and as per which the aforesaid
benefit has been withheld since he was unable to
provide any no objection certificate from the
department concerned. It is also indicated that an
amount of Rs.3,64,112/- has been withheld/adjusted
due to petitioner not depositing the aforesaid
amount in the treasury. It appears that no specific
orders have been passed by the Department concerned
regarding the aforesaid aspect.

4. In view thereof, liberty is granted to
petitioner to make a fresh representation with
regard to his grievance before opposite party No.2
i.e. Director, ESI Labour Medical Services, U.P.
