Heard learned counsel for the petitioner, Sri V.P. Nag, learned counsel for the State and Sri Harsh Vardhan Shahi, Advocate holding brief of Sri Ripu Daman Shahi, learned counsel for Nagar Nigam Lucknow.

Learned counsel for the State has obtained instructions from the concerned Tehsildar, and a copy of the same has been placed before us, which is taken on record. As per the said instructions received by the State, proceedings under Section 67 of the U.P. Revenue Code, 2006, have already been initiated against the illegal encroachment upon Gata No. 1078, recorded as Kumhar Miti, to the extent of 0.2180 hectares.

Once proceedings for removal of illegal encroachment have been initiated against the illegal occupants, we see no reason to keep the present petition pending for the reliefs sought herein. The petitioner is also at liberty to participate in the pending proceedings by filing necessary details of any illegal occupants, if any, who have unduly encroached upon the public utility land. The said proceedings are expected to be decided expeditiously and in accordance with the mandate of law.

It is expected that the revenue authorities shall act strictly in accordance with law, so that no part of the public utility land is allowed to be occupied by any unauthorised person.

The writ petition, with the observations as above, is disposed of .
