Heard learned counsel for the petitioner, learned Standing Counsel for the respondent nos.1 and 2, Shri Mayank Pandey, learned counsel for the respondent no.3 and Shri S. B. Pandey, learned Deputy Solicitor General of India assisted by Shri Varun Pandey, learned counsel for respondent no.4.

By means of this writ petition, the petitioner has prayed for a writ of mandamus commanding the opposite parties not to build the over-bridge in the diversion form, considering the gravity of the public interest, rather it should be constructed in a straight manner.

The construction of the over-bridge, whether in a diversion form or otherwise is a matter which lie within the domain of experts involved in construction work. No material has been placed before us, nor any report has been submitted to suggest that the diversion form of the bridge would be dangerous to the lives of the surrounding residents or occupants of the nearby shops. As such this being a matter to be regulated by the expert opinion, cannot be entertained in the present Public Interest Litigation (PIL).

The larger public interest is also not apparent from the pleadings set out in the writ petition. Even the locus standi of the petitioner to institute such

proceedings has not been established. Thus, the present writ petition, for want of a just cause, cannot be entertained under Article 226 of the Constitution of India.

The writ petition is, accordingly, dismissed.
