This petition purportedly in public interest has been filed by the petitioner aggrieved of the setting up of mobile tower at Gata No. 255, Ward No. 3 situated at Yadav Colony Shikohabad, District Firozabad.

Submissions have been made that the petitioner has made several representations to the district administration against setting up of mobile tower, however, no action has been taken on the said representation.

Submissions have also been made that the mobile tower, if established, would affect the health of the people living around the said tower and, therefore, in public interest, the respondents be restrained from permitting erection of mobile tower at the said place.

We have considered the submissions made and have perused the material available on record.

This Court in Asha Mishra Vs. State of U.P.: (2017) 1 UPLBEC 261 and Residents Welfare Association Vs. Union of India: Writ C No. 16888 of 2022 decided on 11.11.2022, after considering all the related aspects of the matter, has come to the conclusion that there is no scientific sanction qua the submissions made pertaining to alleged ill effects of setting up of mobile tower and seeking to restrain the erection of the mobile tower on the said ground is baseless.
