Sri Yatindra Kumar Dubey, learned counsel for the applicant and Sri Kunwar Tejendra Bahadur, learned AGA, for the State, are present.

The instant application has been filed by the applicant with a prayer to transfer the proceeding of Special Criminal Case No.120 of 2016 (State Vs. Dinesh Gautam and others) arising out of Case Crime No. 31 of 2016, under Sections 147,323,504,336, 325 and 308 IPC, Police Station Etwa, District Siddharth Nagar pending in the court of Additional Sessions Judge/Special Judge (SC/ST Act), Siddharth Nagar to the competent court of District Maharajganj.

After some argument, learned counsel for the applicant submits that however, applicant, who is accused in the case, filed instant transfer application with the prayer to transfer the case from District Siddharth Nagar to District Maharajganj but considering the fact that trial is at its last leg and dates are being fixed for final argument, he does not want to press the instant transfer application on merit and therefore, the instant transfer application may be dismissed as withdrawn.
