- Suit for cancellation of the registered sale deed dated 05.06.1984, filed on behalf of plaintiff has concurrently been discarded by both the courts below.
- It is submitted that the evidence adduced on behalf of the parties has not properly been appraised in right perspective. In my opinion, the lower court record is required before admission of the appeal.
- As such, let the record of the court below be summoned. Defendant nos. 1 to 3 are already represented through their learned counsel.
- List on 07.07.2025 . In the meantime, both the parties are directed to exchange their respective affidavits, if any.
