This application has been moved on behalf of the applicant - Ajay Singh seeking anticipatory bail in Case Crime No.348 of 2023 under Section 306 IPC, Police Station Crossing Republic, District Ghaziabad.

Heard learned counsel for the applicant as well as the learned A.G.A. for the State and perused the record.

A perusal of the anticipatory bail rejection order shows that in the same case crime number under section 376 IPC the accused applicant has already been granted bail in his favour by Special Judge (E.C. Act) / Addl. District & Session Judge, Ghaziabad vide order dated 6.1.2024 and the learned trial court has further mentioned in the order that since in section 376 IPC, the accused applicant has been granted regular bail, now after insertion of section 306 IPC in same crime number in the supplementary charge-sheet, his anticipatory bail application was not held to be maintainable before the Sessions Court.

I find myself in consonance with the observation made by the learned Session Judge. Since out of the two offences, regular bail was granted to the accused applicant for one offence by the trial court, it would also be reasonable to reject the anticipatory bail application of the accused applicant. Accordingly, it is directed that the applicant shall move regular bail application before the trial court in accordance with law and if in case it is rejected by the learned trial court, he may move regular bail application before this Court.

Hence, the anticipatory bail application is rejected.
