Heard learned counsel for the applicant as well as Sri V.P.Tripathi, learned A.G.A. for the State and perused the material available on record.

This application has been filed seeking anticipatory bail in Complaint Case No. 285 of 2021, under Sections 323, 395, 504 IPC, Police Station Kannauj, District Kannauj.

Counsel for the applicant submits that the applicant has been falsely implicated in the present case. Prior dispute exists between the parties. Vague and general allegations have been levelled against the applicant. The applicant has not committed any dacoity. In the alleged incident, the complainant has not received any injury. No injury report has been annexed alongwith the complaint. At this stage, there is no credible evidence to link the applicant with the offence. Identically placed co-accused Anshu @ Amit has been granted anticipatory bail by this Court vide order dated 30.07.2025 passed in Criminal Misc. Anticipatory Bail Application No. 4929 of 2025. The applicant claims parity. The applicant has been summoned by the concerned court. The applicant has no criminal antecedents. The applicant has apprehension of his arrest in the above mentioned case.

Learned AGA as well as the opposite party no.2 are granted three weeks' time to file counter affidavit. Rejoinder affidavit, if any, may be filed within two weeks thereafter.
