Heard learned counsel for the applicant as well as the learned AGA for the State and perused the records.

This is an application seeking anticipatory bail of the applicant in Case Crime No. 280 of 2025 under Sections 319(2), 318(4), 338, 336(3), 340, 316 (2) of B.N.S. registered at Police Station- Kotwali Nagar, District- Gonda.

As per the allegations levelled in the First Information Report, it is alleged that the applicant along with other coaccused are part of land Mafia Gang who by resorting to fraud get the land sold out on different persons by using false identification cards and documents.

It is the case of the copmplainant that the applicant along with the other co-accused were involved in a transaction and transferring of land in pursuance whereof the complainant had paid a sum of Rs. 35 Lakhs.

It is also stated that it is on the instructions of the applicant that the money was paid to the other co-accused and in such circumstances a case against the applicant was made out.

The submission of learned counsel for the applicant is that neither any criminal history has been traced to the applicant and it cannot be said that the applicant is a part of a land mafia gang.

It is also urged that no money transaction has been traced in and from the account of the applicant and as far as the present applicant is concerned, he has been falsely implicated, he has a stable house hold and there is no apprehension of the applicant either fleeing justice rather he undertakes to cooperate in the

proceedings and investigations. Moreover, a commercial property disputes is being imputed to the applicant without any evidence.

The learned A.G.A. submits that as per their instructions, there is an alleged criminal history of four cases against a person namely Sunil Misra, however, the father's name of the said Sunil Misra against whom there are cases is not the one who is the present applicant before the Court.

Issue notice to the opposite party No.3, returnable at an early date.

Learned counsel for the applicant shall take necessary steps in this regard within a period of one week.

Let a counter affidavit be filed within a period of three weeks. The applicant shall have two week's time thereafter for filing the rejoinder affidavit.

List this case in week commencing 22.07.2025.

11.As an interim measure, it is provided that till the next date of listing in the event of arrest of the applicant- Suneel Misra involved in the above-noted case crime, he shall be enlarged on interim anticipatory bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the Station House Officer of the Police Station concerned/ Investigating Officer, subject to the following conditions:

(i) The applicant shall make himself available for interrogation or for discovery of any fact by a police officer as and when required;

¶22

(ii) The applicant shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer;

(iii) The applicant shall not leave the country without the previous permission of the Court.
