Heard learned counsel for applicant and learned A.G.A. appearing on behalf of State.

Power on behalf of informant has been filed by Mr. Pawan Kumar Sharma, Advocate, which is taken on record.

This first anticipatory bail application has been filed with regard to Complaint Case No.05 of 2025 under Section 74 BNS & 7/8 POCSO Act, P.S. Huzurpur, District Bahraich.

As per contents of FIR, incident is said to have taken place on 28.11.2024 at about 12:00 PM when the applicant allegedly forced in the way into the room of informant's daughter and is said to have sexually molested her. Allegation also is levelled that the applicant has illicit relations with the informant's wife.

It is submitted that applicant has been falsely implicated in allegations levelled against him and that the compliant has thereafter been treated as a complaint case with issuance of summons to applicant. It is submitted that in fact the applicant was a driver of the informant and had been removed from service and the FIR has been lodged as a measure of retribution.

Learned A.G.A. as well as learned counsel for informant has opposed bail application with the submission that the contents of FIR are clearly corroborated by the statement of victim. It is also submitted that the applicant had earlier also filed an application under Section 482 Cr.P.C. which was disposed of granting liberty to applicant to seek bail in terms of judgment rendered by Hon'ble Supreme Court.

Upon consideration of submissions advanced by learned counsel for parties and perusal of material on record, prima facie, it appears that complaint filed by the informant has been treated as a complaint case with summons being issued. Looking to the nature of allegations levelled in the statement of

victim, this Court does not find any good ground to grant any indulgence. Liberty, however, is granted to applicant to apply for regular bail, which shall be considered and decided expeditiously.
