Sri Nitesh Kumar and Sri Shailendra, Advocates have filed Vakalatnama on behalf of the informant. The same is taken on record.

Supplementary affidavit filed by the counsel for the applicant, is taken on record.

Heard Sri Anupam Dubey, counsel for the applicant as well as Sri Shailendra, counsel for the informant and Sri Neeraj Kumar Sharma, learned A.G.A. for the State- opposite party. Perused the material placed on record.

This application under Section 482 of Bhartiya Nagarik Suraksha Sanhita has been filed seeking anticipatory bail in Case Crime No. 73 of 2025, under Sections 420, 467, 468, 471 IPC, Police Station Surajpur, District Gautam Budh Nagar.

Counsel for the applicant submits that earlier the applicant lodged an FIR against the informant on 30.05.2024 registered as Case Crime No. 194 of 2024, under Sections 419, 420, 467, 468, 471, 504, 506 IPC, Police Station Beeta-2, District Greater Noida (Commissionerate Gautam Budh Nagar). In counter blast to the said proceedings, the instant prosecution has been instituted against the applicant. The case is purely civil in nature. The applicant has been falsely implicated. At this stage, there is no credible evidence to link the applicant with the offence. Criminal history of the applicant has been explained in paragraph nos. 19, 20 and 21 of the affidavit. It is next submitted that the investigation is going on and the applicant has apprehension of his arrest in the above mentioned case.

The learned AGA and the counsel for the informant may file their respective counter affidavits within three weeks. Rejoinder

affidavit, if any, may be filed within one week thereafter.

Place this case in the additional cause list on 14.05.2025, showing the names of Sri Nitesh Kumar and Sri Shailendra as counsel for the informant.

Till the next date of listing, in the event of arrest, the applicant Rajender Singh be released on interim anticipatory bail in the aforesaid case crime till the submission of police report, if any, under section 173 (2) Cr.P.C., on furnishing a personal bond of Rs.50,000/- with two sureties each in the like amount to the satisfaction of the Station House Officer of the police station concerned with the following conditions:-

(i) the applicant shall make himself available for interrogation by a police officer as and when required;

¶16

(ii) the applicant shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) the applicant shall not leave India without the previous permission of the Court and if he has passport the same shall be deposited by him before the S.S.P./S.P. concerned.

In default of any of the conditions, the Investigating Officer is at liberty to file appropriate application for cancellation of interim anticipatory bail granted to the applicant.

The Investigating Officer is directed to conclude the investigation of the present case in accordance with law expeditiously preferably within a period of three months from the date of production of a copy of this order independently without being prejudiced by any observation made by this Court while considering and deciding the present anticipatory bail application of the applicant.

The applicant is directed to produce a certified copy of this order, before the S.S.P./S.P. concerned within ten days from today, who shall ensure the compliance of present order.
