1. Heard learned counsel for the applicant; learned AGA for the State and perused the records. Sri Vimal Kumar Singh appears for the opposite party no.2.

2. The present application under Section 438 Cr.P.C. has been filed seeking anticipatory bail apprehending arrest in FIR/Case Crime No.0427 of 2025 under sections 87, 137(2), 65(1), 351(3) BNS & Section 5(L)/6 POCSO Act and Section 3(2)(V) SC/ST Act, Police Station Satrikh, District Barabanki.

3. In terms of the FIR, allegations were levelled that the daughter of the informant aged about 13 years was enticed by the applicant. Subsequently, in the statement under section 180 BNSS, the victim stated that she was called and thereafter she had gone to meet the applicant and subsequently both were arrested. It was also stated that on three to four occasions, physical relations were formed in between them. The tentative age of the victim is around seventeen years. In the statement under section 183 BNSS, the victim stated that the applicant was refusing to marry her.

4. Learned AGA opposes the bail application.

5. Considering the fact that physical relations were formed on three to four occasions, the applicant is entitled to the benefit of interim anticipatory bail.

6. Thus, in the event of arrest, let the applicant Vikas Yadav be released on interim anticipatory bail till the next date of listing in the aforesaid FIR number on his furnishing a personal bond of Rs.5,000/- to the satisfaction of Station House Officer concerned with the following conditions:

(a) The applicant shall make himself available for interrogation by a police officer as and when required and will co-operate with the investigation;

(b) The applicant shall not leave India without previous permission of the Court;

¶21

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence;

7. The counsel for the opposite party no.2 may file objection within four weeks.

8. List after four weeks.
