Heard Sri Purnendu Chakravarty, learned counsel for the applicant, Sri Ashok Kumar Srivastava, learned A.G.A. appearing on behalf of the State.

The instant application has been filed by the applicant seeking anticipatory bail in F.I.R. bearing Case Crime No. 832/2024, under Sections 406, 409, 419, 420, 467, 468 & 471 I.P.C., registered at Police Station Dewa, District Barabanki.

The aforesaid case has been registered on the basis of an F.I.R. lodged on 04.12.2024 against 13 persons, not including the applicant, stating that the informant and several other persons had made investments in 15 companies of Time City Group but no refund was paid to them on their investments.

During investigation, it came to light that the applicant was an Additional Director for the Company till the year 2019 and, therefore, his name has also been included as an accused person and the investigation against him is going on.

In the affidavit filed in support of the anticipatory bail application, it has been stated that the applicant is innocent and he has been falsely implicated in the present case.

The learned counsel for the applicant has submitted that in para 16 of the affidavit, the applicant's involvement in 16 other cases has been disclosed and and he has submitted that he was implicated in 10 cases simultaneously on 15.02.2025 as all the cases are of similar nature, arising out of grievance of non payment of returns on the investments made in the Companies of Time City Group. 4 cases have been registered in recently and in 1 case, final report has been filed. named in any of the F.I.Rs and later on it has come to light that he was an Additional Director till the year 2019. In 6 of the aforesaid cases, the applicant has been granted interim anticipatory bail by means of orders dated 13.08.2025, 13.08.2025, 13.08.2025, 16.07.2025, 05.08.2025 and 20.08.2025 passed by this Court in Criminal Misc. Anticipatory Bail Application U/S 482 BNSS Nos.1015 of 2025, 1017 of 2025, 1011 of 2025, 853 of 2025, 964 of 2025 and 897 of 2025 respectively.

The matter requires detailed consideration.

Issue notice to the opposite party no.2 returnable at an early date.

The learned counsel for the applicant shall take requisite steps for issuance of notice within three days from today.

10.The learned counsel for the opposite parties may file a counter affidavit/ short counter affidavit within a period of two weeks'.

List this case in the week commencing 06.10.2025.

Therefore, it is directed that in the event of arrest/appearance of applicant- Deep Chandra Shukla , before the learned Trial Court till the next date of listing, he shall be released on interim anticipatory bail in the aforesaid case crime on his furnishing personal bail bond and two solvent sureties to the satisfaction of the learned Trial Court on the following conditions and subject to any other conditions that may be fixed by the Trial Court:-

(i) That the applicant shall appear before the trial court on each date fixed unless personal presence is exempted;

(ii) That the applicant shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer or tamper with the evidence;

¶23

(iii) That the applicant shall not leave India without the previous permission of the court;

¶24

(iv) That the applicant shall not pressurize/ intimidate the prosecution witness.
