Heard Sri Arun Kumar Singh, learned counsel for the applicant, Sri Atharva Dixit, learned counsel for the first informant and Sri Radhey Shyam, learned A.G.A. for the State and perused the record.

The present application has been moved seeking anticipatory bail in Case Crime no. 223 of 2023 under Sections 419, 420, 467, 468, 471, 406, 506, IPC, Police Station George Town, District Prayagraj with the prayer that in the event of arrest, the applicant may be released on bail.

It is contended by learned counsel for the applicant that a civil dispute has been given coulour of criminality. It is further submitted that a registered agreement to sale was entered into between co-accused Ashwini Singh and the first informant regarding sale of an immovable property and applicant is said to have received Rs. 10,00,000/- as earnest money on behalf of coaccused Ashwini Singh. It is also submitted that offences involved are punishable with maximum imprisonment of seven years and offences under sections 406 and 420 I.P.C. cannot stand together in view of law laid down by Hon'ble Apex Court in 'Delhi Race Club (1940)Ltd and others vs. State of Uttar Pradesh and another', 2024 4 ACR 610 .

On the other hand, learned counsel for the first informant opposed the prayer for grant of anticipatory bail and submits that conduct of the appliant does not entitle him for the relief of anticipatory bail as prior to execution of the present sale deed, the applicant had shown the land to the first informant

and Rs.65,00,000/- was received by him but the papers of the said land turn out to be forged one.

Learned A.G.A. submits that he has not received instructions in the matter as yet.

In view of the above, let the applicant Raj Kumar Singh in the event of his arrest, be released on interim anticipatory bail on his furnishing a personal bond of Rs. 50,000/- with two sureties each in the like amount to the satisfaction of the Court concerned till 22.1.2026 with the following conditions :-

(i) The applicant shall not tamper with evidence and that he would appear before the trial Court on the date fixed unless exempted by the Court concerned;

(ii) The applicant shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her/them from disclosing such facts to the Court or to any police officer;

(iii) The applicant would co-operate during trial and would not misuse the liberty of bail.

(iv) The applicant shall not leave India without prior permission of the Court concerned.

In default of any of the conditions, the prosecution shall be at liberty to file appropriate application for cancellation of the interim anticipatory bail granted to the applicant.

Put up this case as fresh on 22.1.2026.

In the meantime, learned AGA is directed to seek instructions in the matter.
