Heard Sri Mohd. Ayub, learned counsel for the applicant, Sri B.P. Singh, learned counsel for the first informant and Sri S.D. Shukla, learned A.G.A. for the State and perused the record.

The present application has been moved seeking anticipatory bail in Case Crime no. 126 of 2002 under Sections 419, 420, 467, 468, 471, 504, 506, 120-B IPC, Police Station Shahganj, District Agra with the prayer that in the event of arrest, the applicant may be released on bail.

It is contended by learned counsel for the applicant that the applicant has neither executed any sale deed nor he is the beneficiary of the alleged transaction. It is further submitted that chargesheet in the case has already been submitted that similarly placed co-accused Rajesh Kumar Sharma has already been enlarged on anticipatory bail by Co-ordinate Bench of this Court vide order dated 01.8.2025 passed in Crl. Misc. Anticipatory Bail Application No.5885 of 2025.

On the other hand, learned A.G.A. submits that applicant has not filed any affidavit in respect of his application and the same has been filed by his son. He also submits the applicant has not been co-operating in the trial and chargesheet was submitted in the year 2022 and NBW were also issued in the year 2022 itself.

In view of the above facts and circumstances and without expressing any

opinion on the merit of the present case, let the applicant Avnindra Solanki Alias Daizy Singh in the event of his arrest, be released on interim anticipatory bail on his furnishing a personal bond of Rs. 50,000/- with two sureties each in the like amount to the satisfaction of the Court concerned till 12.1.2026 with the following conditions :-

(i) The applicant shall not tamper with evidence and that he would appear before the trial Court on the date fixed unless exempted by the Court concerned;

(ii) The applicant shall not directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her/them from disclosing such facts to the Court or to any police officer;

(iii) The applicant would co-operate during trial and would not misuse the liberty of bail.

(iv) The applicant shall not leave India without prior permission of the Court concerned.

In default of any of the conditions, the prosecution shall be at liberty to file appropriate application for cancellation of the interim anticipatory bail granted to the applicant.

Put up this case as fresh on 12.1.2026.

In the meantime, applicant shall file his personal affidavit in support of the application and he is also directed to file supplementary affidavit bringing on record the entire ordersheet of the learned trial court.
