Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

Learned Counsel for applicant has prayed to direct the the learned Village Court, Karhal, Mainpuri to decide the proceedings of Petition No.25 of 2024 ( Damini Vs. pankaj Sharma) under Section 147 BNSS, at Police Station Karhal, District Mainpuri as expeditiously as possible.

It is apparent from records that a petition No.217 / 2018 ( Damini vs Pankaj) under Section 125 Cr.P.C was filed and same was decided by Shri Rajiv Kumar Pal, Nyayadhikari, Gram Nyayalay on 30-11-2024. Applicant thereafter filed an execution Petition No.25/2024 (Damini vs Pankaj) under Section 147 of BNSS before the same court.

In given circumstances, this Court is surprised to see as to how a petition under Section 125 Cr.P.C was entertained by Presiding Officer of Gram Nyayalay, who lacks the jurisdiction. Hence, an explanation be called from the the concerned judicial officer through District Judge, Mainpuri.
