Heard learned counsel for the applicant and learned A.G.A. for the State.

Challenging the charge-sheet and summoning/cognizance order dated 10.10.2024 in Case No.6457 of 2024 (State vs. Hafij Jalil and others), arising out of Case Crime No.402 of 2023, under Sections 420, 406, 468, 471, 120B, 504, 506 IPC, Police Station Tanda, District Rampur, submission has been made that the allegation leveled against the applicant was to the effect that he had facilitated payment of money from time to time by the informant, in relation to the proposed marriage of her daughters, with Satyadham Samajik Seva and Jan Kalyan Samiti, having its head office at Vishal Nagar, Jaspur Khurd, Kashipur, District Udham Singh Nagar. It is alleged that the name of the said Society as reflected from the receipts, mentioned in the FIR, is Satya Dham Ardhnarishwar Mandir Trust and the applicant has no concern with the said Trust or Society, particularly when he belongs to muslim religion. Further submission is that manager of the Society has also been made co-accused but the applicant has been falsely implicated without there being any evidence of his involvement in the matter and after three years, an application under Section 156 Cr.P.C. was lodged, which resulted into registration of the impugned F.I.R.

Matter requires consideration.

Issue notice to opposite party No.2.

Six weeks' time is granted to the opposite parties for filing counter affidavit.

Two weeks' time thereafter is granted to the applicant for filing rejoinder affidavit.

List this case in the last week of September, 2025 before appropriate Bench.

¶12

Till the next date of listing, no coercive action shall be taken against the applicant in the aforesaid case.

It is made clear that this protection has been granted only to the applicant considering his case only.
