High Court of Judicature at Allahabad (Court No. - 79), bench of Hon’ble Tej Pratap Tiwari, J. — order dated December 18, 2025 in Application U/S 528 BNSS No. - 50667 of 2025, Jay Karan Singh Rajpoot v. State of U.P. and Another. Counsel for the applicant relied on the settlement agreement recorded in paragraph-9 of the divorce petition under Section 13 of the Hindu Marriage Act annexed at page 42 of the application, whereby the parties agreed to settle their criminal cases, including the case against which the present Section 528 BNSS application was preferred, and gave an undertaking to file the compromise before the court concerned within three weeks. Heard Sri Ajay Singh Sengar, learned counsel for the applicant, Sri Akshay, learned counsel for opposite party no.2, learned A.G.A for the State and perused the record.

At the outset, learned counsel for the applicant contended that at page 42 of the instant petition, the copy of the petition filed under Section 13 of Hindu Marriage Act has been annexed, wherein, in paragraph-9 it has been mentioned that the parties have made the agreement to settle their criminal cases including the case against which the present criminal misc. application under Section 528 BNSS has been preferred. As regards to the compromise, the learned counsel for the applicant has submitted the undertaking before the Court that he will file the same before the court concerned within three weeks.

As prayed, the parties are allowed to appear before the court concerned with three weeks from today and submit the compromise deed signed by all the parties and after is verification, the report along-with original/certified copy of the compromise be submitted to this Court by way of supplementary affidavit.

List this case on 20.01.2026.

Till the next date of listing, no coercive action shall be taken against the applicant.
