Heard learned counsel for the applicant, learned counsel for the opposite party no.2 and learned A.G.A. for the State.

The present 528 B.N.S.S. application has been filed to quash the impugned order dated 27.10.2025 passed by Learned Special Judge (SC/ST Act) Prayagraj (Allahabad) in S.S.T. No. 32/2024 (State Vs. Jalim Singh and Another), arising out of case Crime No. 237/2024 under Sections 323, 504, 506, 427 I.P.C. & 3(2)5A, 3(1) Da, Dha of SC/ST Act, Police StationHolagarh, District-Prayagraj (Allahabad) by which the learned Special Judge rejected the application for exemption of the appearance, issued N.B.W. against the applicant and cancel his personal bail bond.

Learned counsel for the applicant submits that applicant was released on bail on 22.04.2024, thereafter, he appeared on various dates but on one date he could not appear and moved exemption application but trial court rejected his exemption application and issued NBW.

Keeping in view the aforesaid facts and circumstances of the case and in the interest of justice, the present 528 BNSS application is accordingly, disposed off.

However, if the applicant moves recall application before the concerned court below for recalling the NBW, within two weeks from today, the court below shall decide his application in accordance with law, expeditiously,

For the period of two weeks from today, no coercive action shall be taken against the applicant.
