Heard Sri Rajan Srivastava, learned counsel for applicants and Ms. Pratiksha Rai, learned brief holder for the State.

The present application has been preferred for seeking quashing of the non-bailable warrant dated 2.2.2024 and subsequent orders of issuing non bailable warrant in Magistrate Trial No. 776 of 2009 (State vs. Manoj Kumar and others), arising out of Case Crime No. 1 of 2006, under Sections 147, 323, 332, 353 of I.P.C. and Section 2/3 of Prevention of Damage to Public Property Act, P.S. Kotwali, District Ardha Kumbha Mela, pending in the court of A.C.J.M., Prayagraj.

After arguing at some length, learned counsel for applicants confined his prayer only to the extent that the present application may be disposed of finally with a direction to the court concerned that in case applicants surrender before it and apply for bail in pursuance of NBW order dated 2.2.2024, the same may be considered and decided expeditiously in accordance with law to which learned AGA has no objection.

In view of the aforesaid, the instant application is finally disposed of with a direction to the court concerned that in case, the applicants surrender before the court concerned within a period of three weeks from today and apply for bail in pursuance of NBW order dated 2.2.2024, the same shall be considered and decided expeditiously in accordance with settled law.

However, it is made clear that till three weeks from today, no coercive action shall be taken against the applicants herein in the present case.
