Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

This application under Section 528 BNSS has been filed to allow this application and to quash the impugned order dated 03.10.2025 passed by Principal Judge, Family Court, Rampur and direct the concerned Court to summon the P.W.-1 Priyanka Verma for cross-examination in Criminal Misc. Case No. 490 of 2024 (Smt. Priyanka Verma Vs. Surendra Singh) under Section 144 B.N.S.S., Police Station-Civil Lines, District-Rampur pending in the Court of Principal Judge, Family Court, Rampur.

It has been submitted by learned counsel for the applicant that during the trial proceedings, the examination-in-chief of opposite party No. 2 was recorded but due to non-presence of counsel for the applicant an adjournment was sought. Learned Family Court has rejected the adjournment application of the applicant fixing the date for cross-examination of the opposite party No. 2.

Learned counsel for the applicant submits that in case, the said opportunity is not given, injustice may be caused to the applicant.

Accordingly, in the interest of justice, the applicant shall deposit a cost of Rs. 10,000/- within a period of three weeks from the
