Heard Shri Ramesh Kumar Shukla, learned counsel for the applicant and Shri Alok Mishra, learned A.G.A. for the State.

The present application under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the applicant to quash the order dated 7.8.2025 passed by Additional Sessions Judge, Court No. 2, Azamgarh in Session Trial No. 72 of 2021, arising out of case crime No. 226 of 2018, whereby trial court dismissed an application under Section 319, Cr.P.C., which has been filed by the present applicant as first informant.

Learned counsel for the applicant does not want to press this application and wants liberty to file appropriate application/proceedings before the court of competent jurisdiction.

The instant application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.

Office shall return the certified copy of the order to the learned counsel for the applicants, after retaining a xerox of the same.
