Argument of the learned counsel for the appellant is that an accident is said to have occurred on 17.02.2016 of which an FIR is said to have been lodged after more than two months on 21.04.2016 in which the number of the offending vehicle was indicated as UP32D-0782. In the charge-sheet, which had been filed by the police, the vehicle number was indicated as UP42T-8245.

Contention is that in the written statement filed before the Tribunal a specific plea had been taken that there cannot be any occasion of change of the vehicle, which had caused the accident and once the claimant himself took more than two months to lodged the FIR consequently he was remembering the vehicle number which infact had been indicated in the FIR and consequently there cannot be any occasion for change of the vehicle number at the time the authorities submitted the charge-sheet and thus the matter is required to be investigated by the S.I.T. It is contended that the said plea has been conveniently rejected by the learned Tribunal without appreciating the said fact.

It is provided that in case the awarded amount along with interest as of today is deposited before this Court within a period of six weeks, then further proceedings arising out of the impugned award dated 12.12.2024 passed by the learned Motor Accident Claim Tribunal, Ayodhya in Motor Accident Claim Petition No.376 of 2020 In Re Indrajeet Singh vs Sriram General Insurance Company Limited & Ors, shall remain stayed. Upon deposit of the aforesaid amount, the said

amount be placed in fixed deposit for a period of one year with automatic renewal.
