Heard learned counsel for the revisionists and learned A.G.A. for the State.

The present revision has been filed by the revisionists challenging the impugned order dated 10.09.2025 passed by the learned Additional District and Sessions Judge, Court No. 1, Kasganj, in Sessions Case No. 606 of 2024 (State of U.P. vs. Adesh and others), arising out of Case Crime No. 13 of 2019, under Section 307 I.P.C., Police Station Amanpur, District Kasganj, whereby the learned trial court has rejected the discharge application of the revisionists under Section 227 Cr.P.C.

Learned counsel for the revisionists submits that the impugned order dated 10.09.2025 is arbitrary and illegal and therefore is liable to be set aside. It is further submitted that the learned trial court has not exercised its judicial mind. The entire story as alleged in the complaint filed by opposite party no. 2 is forged and fabricated.

Learned A.G.A. has opposed the submissions of learned counsel for the revisionists and has stated that the injured sustained firearm injuries. There is no illegality in the impugned order. The learned trial court has specifically recorded that as per the written complaint, the accused had stopped the tractor of the complainant by showing arms. Ajai and Umesh abused him. Akhilesh and Adesh fired upon him, and the bullets and pellets struck his leg. The F.I.R. was lodged. The final report was submitted thereafter. The complainant then filed a protest petition. On the basis of the protest petition, after recording the statements of P.W.-1 Sant Kumar, P.W.-2 Santosh Kumar

and Dr. Danesh Husain as P.W.-3 under Sections 200 and 202 Cr.P.C., the eye-witnesses supported the incident. The doctor who medically examined the complainant also verified that the injured had suffered firearm injuries. Hence, the revisionists were summoned under Section 307 I.P.C. No minitrial could be conducted at the stage of consideration of discharge, and the allegations of altercation, abuse, and firearm injury stand duly corroborated by the witnesses of fact as well as the expert witness (doctor) who conducted the medical examination of the injured. The injuries were caused by firearm weapons and the pellets and bullets struck the leg of the injured.

In view thereof, neither is there any illegality nor irregularity in the impugned order dated 10.09.2025.

The criminal revision is liable to be dismissed. It is dismissed accordingly.
