Heard learned counsel for the revisionist and the learned AGA for the State.

The present criminal revision has been preferred by the revisionist being aggrieved by the impugned order dated 16.10.2025, passed by the Special Judge ( POCSO Act)/Additional District & Sessions Judge, Ghaziabad on Application U/s 311 Cr.P.C (24 Kha) in Session Trial No. 179 of 2022 (State Vs. Satish), arising out of case crime No. 684 of 2022, under Section 354-Kha IPC and Section 5/6 of the Protection of Children From Sexual Offences Act, 2012, Police Station Vijay Nagar, District Ghaziabad, whereby the said application under Section 311 Cr.P.C for crossexamination has been rejected.

Learned counsel for the revisionist has submitted that the examination-in-chief of the complainant of the case Jitendra Kumar as PW-1 was recorded on 10.1.2023 and due to some unavoidable circumstances, he could not be able to cross examine the said witness.

It is settled law that opportunity has to be provided for proper adjudication and for fair decision of the trial.

Accordingly, in the interest of justice, an opportunity is provided to the revisionist to cross-examine the PW-1/Jitendra Kumar. The revisionist is directed to crossexamine PW-1 on the very same day when he would appear before the learned trial court concerned for his cross-examination. The revisionist shall also pay Rs. 10,000/(ten thousand) to PW-1/complainant on the same day.

In default of the condition mentioned herein above, the revisionist would not be entitled for cross-examination. If any adjournment is moved by the revisionist to delay the cross-examination with PW-1, then that shall be allowed on payment of a cost not less than Rs. 5000/.
