Heard learned counsel appearing for the revisionist and learned Additional Government Advocate appearing for the State.

The instant revision has been filed challenging therein, the judgment and order dated 29.05.2017 passed by the learned Additional Chief Judicial Magistrate, Court No.7, Ghaziabad whereby, the revisionist had been convicted for the offences punishable under Sections 411 and 482 I.P.C. and had been sentenced for simple imprisonment of one year.

The revisionist through this revision has also challenged the judgment and order dated 1.2.2025 passed by the learned Additional District & Sessions Judge, Court No.16, Ghaziabad in Criminal Appeal No.73 of 2017 (Ashwani Shukla & others Vs. State of U.P.) whereby, the appeal filed by the revisionist had been dismissed and the order of conviction and sentenced had been affirmed.

Learned counsel appearing for the revisionist has submitted that there is no independent witness of the crime in question and only on the basis of the testimony given by the police personal, the revisionist had been convicted.

For the purpose of bail, learned counsel appearing for the revisionist has submitted that during trial and appeal, the revisionist was on bail and after dismissal of the appeal, the revisionist is in judicial custody since 1.2.2025.

I have considered the arguments advanced by the learned counsel appearing for the revisionist and prima facie, I am of the view that the revision is worth consideration.

Accordingly, summon the record of the trial court.

Let this matter be listed after four months for hearing.

The trial court is directed to enlarge the revisionist on bail, on

furnishing two sureties and a personal bond to its satisfaction.
