Heard learned counsel for the revisionist and learned AGA for the State.
The instant criminal revision has been preferred against the order dated 24.1.2025 passed by Additional Principal Judge, Family Court No. 2, Meerut in Case No. 31 of 2024 (Smt. Suman Versus Dr. Sunil Kumar), whereby the objection 10 Ba filed by the revisionist has been rejected and he has been directed to pay entire arrears of maintenance in four equal monthly installments to the applicant in her account or in cash and the first installment is payable on 21.2.2025 in execution case arising therefrom.
Learned counsel for the revisionist submits that as amount of maintenance awarded in the impugned judgement is on higher side and recovery proceedings are under way, therefore, some interim order may kindly be passed increasing the number of installments in order to make the payment easier.
Keeping in view the contention of learned counsel for revisionist, no useful purpose would be served in keeping the revision pending before this Court.
In view of the above, it is directed that arrears of maintenance as directed by the impugned order dated 24.1.2025, which comes to around Rs. 23,07,166/-, as stated by learned counsel for revisionist, will be payable in seven monthly installments
till February, 2025. First installment will be payable on 10.3.2025 and thereafter six remaining installments will be payable on 21st day of succeeding months.
The revision is allowed in part and impugned order dated 24.1.2025 is modified to the extent indicated hereinabove. Order Date :- 13.2.2025 HR
