Heard learned counsel for the petitioner and learned AGA for the State.

Issue notice to respondent no. 2.

Learned counsel for the revisionist submits that it is the admitted case of opposite party no. 2 that she is living in adultery with some other person. Specific pleading was taken in the objection filed by the revisionist before the learned Family Court as well as proceedings of mediation which took place under Section 13 of Hindu Marriage Act wherein opposite party no. 2 admitted the fact that she is in live in relationship with some other person, still without adverting any finding on this aspect, learned court below has passed interim maintenance order of Rs. 5000/- per month in favor of respondent no. 2.

Perused the record.

Perusal of the impugned order dated 24.04.2024 as well as mediation proceedings in the divorce case between the parties, prima facie show that respondent no. 2 has admitted her relationship with some other person.

The matter, prima facie, requires consideration.

List on 20.02.2025.

¶9

Till further orders of the Court, the impugned order dated 19.03.2024 passed by the Additional Chief Judicial Magistrate, Court No. 28, Lucknow, shall remain stayed.
