Heard learned counsel for the revisionist, learned A.G.A. for the State and perused the record.

This Criminal Revision under Section 438 read with Section 442 BNSS, 2023 [(akin to Section 397 read with Section 401 Cr.P.C.) (now repealed)] has been filed impeaching the impugned order dated 24.09.2025, passed by the Special Judge (POCSO Act), (in short "Trial Court"), Hardoi in Crl. Misc. Case No.11/2025 (Sanjay Vs. Naveen), under Section 173 (4) BNSS [(akin to Section 156(3) Cr.P.C. (now repealed)].

The relevant portion of the impugned order reads as under :-

" पिरवादी के िवद्वान अिधवक्ता को सुना और पत्रावली का अवलोकन िकया।

पिरवादी की पुत्री ने अपने बयान में कथन िकया है िक िदनांक 23.09.2024 को समय 3.30 बजे जब मैं स्कूल से घर आ रही थी, तो मुझे िवपक्षी नवीन िमला मोटरसाइिकल से था, उसने मुझे कहा िक मेरे साथ चलो, तो मैं तुम्हें घर छोड़ दूंगा, में िवश्वास करके उसके साथ बैठ गयी, वह मुझे घर नहीं ले गया गन्ने के खेत में ले गया, वहां पर उसने मेरे साथ गलत काम िकया, िफर मुझे अपने मामा के घर ले गया। मामा के घर मैं एक रात रही, िफर नवीन के मामा अगले िदन नवीन के घर ले आये। नवीन के घर से सुबह तीन बजे पुिलस ने मुझे नवीन के घर से पकड़ िलया था। पुिलस मुझे पकड़कर थाने ले गयी थी। नवीन के साथ मेरी दोस्ती नहीं है और न ही प्रेम संबंध है। नवीन को एक साल से जानती हूँ। नवीन ने गन्ने के खेत में मेरे साथ गलत काम िकया, तब मैंने िवरोध िकया था। नवीन ने मुझे मारापीटा था। मारपीट में मुझे चोट लगी थी। नवीन के मामा के घर हम मोटरसाइिकल से एक घण्टे में पहुंचे थे। मैं 25.09.2024 को अपने घर आ गयी थी। मैंने अपनी दादी को घटना के बारे में बताया था। मैं नवीन के मामा को पहले से ही जानती थी।

पिरवाद में किथत तथ्यों और पीिड़ता के बयान के अनुसार िवपक्षी नवीन ने पीिड़ता के साथ जबरन बलात्कार की घटना कािरत की है। बलात्कार की घटना से पूवर् िवपक्षी के साथ पीिड़ता का मोटरसाइिकल पर बैठकर जाना तो िवश्वास योग्य है, परन्तु यह िवश्वास योग्य नहीं है िक बलात्कार की घटना के बाद भी पीिड़ता िवपक्षी के साथ मोटरसाइिकल पर बैठकर उसके मामा के

घर तक चली गयी और उसने कोई िवरोध नहीं िकया और न ही शोर मचाया, जबिक पीिड़ता के बयान के अनुसार मामा के घर पहुंचने में मोटरसाइिकल से एक घण्टा का समय लगा था। इससे घटना की सत्यता संिदग्ध प्रतीत होती है।

पिरवाद में किथत तथ्यों के अनुसार घटना के दूसरे िदन िवपक्षी का मामा सुभाष पिरवादी की पुत्री को थाने पर छोड़कर चला गया था, जब के पीिड़ता ने अपने बयान में कथन िकया है िक सुभाष उसे नवीन के घर छोड़कर चला गया था और नयीन के घर से पुिलस ने सुबह 3 बजे उसे पकड़ िलया था। स्पष्ट है िक घटना के ताित्वक तथ्य के संबंध में पिरवाद और पीिडता के बयान में िवरोधाभास है, इससे भी घटना की सत्यता संिदग्ध प्रतीत होती है।

किथत बलात्कार की घटना िदन की बतायी गयी है तथा घटनास्थल एक सावर्जिनक खुला स्थान बताया गया है, परन्तु किथत जबरन बलात्कार की घटना की िकसी को जानकारी नहीं हुई और न ही घटना में पीिडता को कोई शारीिरक चोट आना बताया गया है, इससे भी घटना की सत्यता संिदग्ध प्रतीत होती है।

साक्ष्य के अनुसार पीिड़ता का िवपक्षी के साथ कोई प्रेम संबंध नहीं था और न ही कोई िमत्रता थी, ऐसी िस्थित में िवपक्षी पीिड़ता को अपने मामा के घर क्यों और िकस मकसद से लेकर गया, इसका कोई कथन पिरवाद में या साक्षीगण ने अपने बयान में नहीं िकया है, इससे भी घटना की सत्यता संिदग्ध प्रतीत होती है।

िविध व्यवस्था मैससर् पेप्सी फूडस िलिमटेड और अन्य बनाम िवशेष न्याियक मिजस्ट्रेट व अन्य 1998 (36) ए.सी.सी. पेज 20 में माननीय उच्चतम न्यायालय द्वारा यह अवधािरत िकया गया है िक आपरािधक मामलों में अिभयुक्त की तलबी एक गंभीर िवषय है। पिरवादी पिरवाद में किथत आरोपों के समथर्न में दो सािक्षयों को प्रस्तुत करके आपरािधक िविध को प्रचलन में नहीं ला सकता है।

अतः उपरोक्त िववेचन के आधार पर िवपक्षी के िवरूद्ध पॉक्सो एक्ट के अन्तगर्त कायर्वाही िकया जाना न्यायोिचत प्रतीत नहीं होता है तथा पिरवाद िनरस्त िकये जाने योग्य है।

आदेश

पिरवाद सं० 11/2025 संजय बनाम नवीन िनरस्त िकया जाता है। पत्रावली िनयमानुसार दािखल दफ्तर हो"

This Court considered the observation made by the Trial Court in the impugned order, quoted above, as also the following facts :-

(i) On 23.09.2024, at about 3.30 P.M. the victim/daughter of the complainant/revisionist was enticed away by the opposite party No.4-Naveen and thereafter he committed rape with the victim in the agriculture field and thereafter the opposite party No.4 along with the victim/prosecutrix reached the house of his maternal uncle, Subhash, where both stayed for one night

(ii) Thereafter, the maternal uncle of the opposite party No.4 namely Subhash brought the opposite party No.4 along with the prosecutrix/victim to the Police Station - Tadiyawan, District-Hardoi from where the police handed over the custody of the prosecutrix/victim to the complainant.

(iii) The statement of the prosecutrix/victim, which is liable to be taken note of, before

the Trial Court indicates as under:-

(a) The prosecutrix/victim and opposite party No.4 were neither friend, nor were in love. However, they were known to each other for one year.

(b) The victim stayed for one night in the house of Subhash, the maternal uncle of the opposite party No.4, and thereafter the maternal uncle of the opposite party No.4 along with the prosecutrix/victim came to the house of the opposite party No.4 from where police officials of the Police Station-Tadiyawan, District- Hardoi took the custody of the prosecutrix/victim whose custody thereafer was handed over to the complainant.

(iv) The statement of the complainant and the victim indicate that the opposite party No.4 enticed away the victim/prosecutrix on 23.09.2024 and the alleged crime was committed on 23.09.2024 by the opposite party No.4-Naveen and thereafter on 24.09.2024 the victim reached her parental house.

(v) To support the allegations made in the complaint no medical evidence was filed before the Trial Court.

(vi) The aforesaid facts indicate that the opposite party No.4-Naveen was not apprehended by the police.

(vii) The application under Section 173 (4) of BNSS was filed after huge delay of about 04 months on 30.01.2025.

Upon due consideration of the aforesaid, this court finds that the Trial Court/Special Judge, POCSO Act, Hardoi has not committed any illegality/infirmity in rejecting the complaint vide the impugned order after observing that the case as pleaded in the complaint has not been supported by the victim while making her statement under Section 223 of BNSS.

In view of the aforesaid, this court finds no force in the revision. It is accordingly dismissed.
