Supplementary affidavit filed today by learned counsel for the petitioners is taken on record.

Issue notice to opposite party no.3 returnable at an early date.

By means of this writ petition, the petitioners have prayed for following reliefs:-

"(i) Issue a writ, order or direction in the nature of certiorari quashing the impugned first information report dated 18.05.2025 registered in case crime no. 0085 of 2025, under section-87 of B.N.S. P.S. Katka, DistrictAmbedkar Nagar (Annexure no. 1) to this writ petition.

(ii) Issue a writ, order or direction in the nature of mandamus commanding the respondent no. 2 not to arrest the petitioner no.2 in pursuance to the impugned first information report dated 18.05.2025 registered in case crime no. 0085 of 2025, under section-87 of B.N.S. P.S. Katka, District-Ambedkar Nagar, till evidence against him."

Learned counsel for the petitioners has stated that both the petitioners being a major persons have got married on 29.05.2025 at Arya Samaj Mandir Sector H (Harsh Vihar Puraniya), Aliganj, Lucknow, certificate of marriage and photographs have been enclosed as Annexure No.S.A.-1. Learned counsel for the petitioners has stated that after the marriage both the petitioners are living together happily. Further, since the mother of petitioner no.1 was not agreeable on that marriage, therefore, the impugned FIR has been lodged.

Let the counter affidavit be filed within a period of four weeks. Rejoinder affidavit, if any, may be filed within two weeks thereafter.

9. List this case in the week commencing 28.07.2025 as fresh.

Till the next date of listing or till filing of the police report, whichever is earlier, the petitioner no.2 shall not be arrested in the aforesaid case crime number. However, both the parties shall cooperate in the investigation.

The petitioners shall appear before the Investigating Officer on 11.06.2025 for the purposes to cooperate in the investigation and shall further cooperate in the investigation till its completion, failing which, the benefit of this order shall not be extended to the petitioners and they may be arrested by the police.
