Heard Mr. Gaurav Tiwari, Advocate, holding brief of Mr. Anjani Kumar, the learned counsel for petitioners and the learned A.G.A. representing State respondents 1, 2 and 3.

Petitioner Anil Kumar Yadav @ Anil and 2 others have approached this Court by means of present writ petition with the following prayer:-

"I. Issue a writ order or direction in the nature of certiorari quashing the impugned First Information Report dated 16.10.2025 in Case Crime No. 0369 of 2025 Under Section 115(2), 324(2), 351(3), 352 B.N.S. Police Station Saidpur, District Ghazipur.

II. Issue a writ order or direction in the nature of mandamus directing concerned 04 NOV 2005 the police officials not to arrest the petitioners pursuant to the Case Crime No. 0369 of 2025 Under Section 115(2), 324 (2), 351(3), 352 B.N.S. Police Station Ghazipur. Saidpur, District

III. Issue any other suitable writ, order ΟΣ direction as this Hon'ble Court may deem fit and proper under the facts and circumstances of the case.

IV. To award costs of the petition in favour of the petitioners."

On the matter being taken up, the learned A.G.A. submits that the charge sheet/police report in terms of Section 193 B.N.S.S. has already been submitted by the Investigating Officer after completion of investigation of concerned case crime number.

When confronted with above, the learned counsel for petitioners submits that he be permitted to withdraw the present writ petition with liberty to challenge the police report before appropriate Court by taking appropriate proceedings.

Learned A.G.A. representing State respondents has no objection to the prayer made by the learned counsel for petitioners.

In view of above, writ petition is, accordingly, dismissed as withdrawn with the liberty aforesaid.
