Heard learned counsel for the petitioner, learned A.G.A. for the State and Sri Utkarsh Khanna, learned counsel for the respondent no. 3.

The present petition has been filed seeking quashing of the first information report dated 17.10.2025 in Case Crime No. 441 of 2025, under Sections316(5), 318(4), 111(2)(b) B.N.S. (409, 420 I.P.C.), Police Station- Lanka, District- Kashi Commissionerate, Varanasi.

Contention of learned counsel for the petitioner is that the matter is a purely commercial one.

Sri Utkarsh Khanna, learned counsel for the respondent no. 3 states that he has to get instructions in the case.

Put up this case as fresh on 27.11.2025 along with Criminal Misc. Writ Petition No. 25551 of 2025.

Till then, the petitioner shall not be arrested in pursuance of impugned first information report since we prima facie find that the issue involved in the first information report is a commercial one.
