Heard learned counsel for the petitioners and learned AGA for the State.

This writ petition has been filed seeking the quashing of the First Information Report dated 9.7.2025 registered as Case Crime No. 239 of 2025, under Sections 137(2), 87, 352 and 351(2) of B.N.S., 2023, Police Station - Ghiror, District - Mainpuri.

Learned counsel for the petitioners prayed that the writ petition be dismissed as not pressed vis-a-vis petitioners no. 1 and 2.

The prayer is accepted.

The writ petition is, accordingly, dismissed as not pressed vis-a-vis petitioners no. 1 and 2 .

So far as the petitioners no. 3, 4 and 5 are concerned, it has been informed that they are family members of the petitioner no. 2.

Matter requires consideration.

The respondents no. 1 and 2 are represented by the learned AGA.

The respondents may file counter affidavits within a period of three weeks. Rejoinder affidavit, if any, may be filed within a period of two

Till the next date of listing or till submission of police report, whichever is earlier, the petitioner shall not be arrested pursuant to the aforesaid impugned first information report subject to his cooperation in the investigation. In the event, the petitioner does not cooperate in the investigation, the police will be at liberty to move this Court.
