Applicant-Appellant, namely, Deepak Alias Jitu has applied for suspension of sentence during pendency of the appeal, arising against the judgment of conviction and order of sentence dated 03.01.2025 passed by Additional Session Judge/F.T.C. court no.3, Muzaffarnagar, in Sessions Trial No.467 of 2020, titled State of U.P. Vs. Deepak @ Jitu, thereby convicting the appellant under Sections 272 I.P.C. and Section 60(1) Excise Act, followed by imposition of sentence of six years imprisonment U/s 272 IPC with fine of Rs.5,000/-, one year imprisonment U/s 60(1) Excise Act with fine of Rs.2,000/- with further condition that in the event of non- deposit of fine(s), convict shall undergo further imprisonment of six months and one month imprisonment.
The applicant-convict was prosecuted through Case Crime No.155 of 2015, under Sections 60/72 Excise Act and under Sections 272 and 273 I.P.C., registered at Police Station- Chappar, DistrictMuzaffarnagar.
