Heard learned counsel for the appellants and learned A.G.A. for the State.

The instant Criminal Appeal under Section 14(A)(1) of S.C./S.T. Act has been filed against the judgment and order dated 15.01.2025 passed by learned Special Judge, S.C./S.T. Act, Shrawasti in Sessions Trial No.100028/2012 arising out of Case Crime No.637/2011, Police Station Ikauna, District Shrawasti, convicting and sentencing the appellants under Section 323/34 I.P.C. for one year rigorous imprisonment alongwith fine of Rs.1,000/-, under Section 324/34 I.P.C. for two years rigorous imprisonment alongwith fine of Rs.5,000/-, under Section 325/34 I.P.C. for three years rigorous imprisonment alongwith fine of Rs.10,000/-, under Section 504 I.P.C. for two years rigorous imprisonment alongwith fine of Rs.1,000/-, under Section 506 I.P.C. for three years rigorous imprisonment alongwith fine of Rs.10,000/- and under Section 3(1)(X) of S.C./S.T. Act for three years rigorous imprisonment alongwith fine of Rs.10,000/- with default stipulations.

Summon the trial court record.

Learned A.G.A. has accepted notice on behalf of opposite party No.1/State.

Let notice be issued to opposite party No.2 returnable at an early date.

Steps be taken within a week from today.

Learned A.G.A. for the State as well as opposite party No.2 may file objections to the bail application within four weeks.

List this case after four weeks.

Learned counsel for the appellants submits that the appellants, Kamta Prasad Yadav and Menhi Lal have already been granted interim bail by the learned trial court vide order dated 15.01.2025.

Accordingly, it is directed that till the next date of listing, the appellants, Kamta Prasad Yadav and Menhi Lal shall remain on interim bail with the same terms and conditions as imposed by the learned trial court while granting the interim bail to the appellants. The appellants are also directed to deposit 50% of the fine imposed by the learned trial court within one month and the remaining 50% of the fine shall remain stayed.
