1. Heard learned counsel for the appellants and learned A.G.A.

A prayer for bail has been made by the appellants/ applicants in this criminal appeal, which has been filed against the judgement and order dated 5/7.07.2025 passed by learned Additional District and Sessions Judge/Special Judge, POCSO Act, Court No.3, Lucknow in Session Trial No.538 of 2014 arising out of Case Crime No.75 of 2014, under sections 354-A, 323, 325, 504 I.P.C., Section 7/8 of Protection of Children from Sexual Offences Act, 2012 Police StationAshiyana, District- Lucknow.

3. Learned counsel for the appellants/ applicants has submitted that appellants/ applicants were falsely implicated in the present case. He further submitted that during trial, appellants/ applicants were on bail and they did not misuse the liberty of bail. He next submits that after conviction, the appellants/ applicants have been enlarged on interim bail. He also submits that the appeal is

already admitted and as there is no possibility of conclusion of the appeal in near future, the appellants are entitled for regular bail.

4. Learned A.G.A. vehemently opposes the prayer for bail, but he does not dispute the fact that after conviction, the appellants/ applicants have been enlarged on interim bail.

Having heard the submissions made by learned counsel for the parties and perused the material brought on record, it is undisputed fact that after conviction, the appellants/ applicants have been enlarged on interim bail. Therefore, this Court is of the view that the appellants/ applicants are entitled to be released on bail during the pendency of criminal appeal before this Court.

6. Hence, prima facie, case for bail is made out, at this stage.

7. Accordingly, the application for bail is allowed .

8. Let the appellants/ applicants, namely, Anuj Srivastava alias Anshu and Ankit Srivastava involved in aforesaid case be released on bail on their furnishing personal bonds of Rs.20,000/- and two sureties each in the like amount, subject to following conditions;

(i) The appellants/ applicants shall cooperate in the disposal of appeal without seeking unnecessary adjournment.

(ii) The appellants/ applicants shall not indulge in any criminal activity or commission of any crime after being released on bail.

9. As soon as personal bonds and sureties are furnished, photocopies of the same are directed to be transmitted to this Court forthwith by the trial court concerned to be kept on record of this appeal.

10. In case of breach of any of the above conditions, it shall be a ground for cancellation of bail.

11. It is further directed that the realization of the

fine amount awarded to the appellants/ applicants shall remain stayed during the pendency of this appeal.
