Subhash vs State of U.P.

This criminal appeal has been filed against the judgement and order dated 10.9.2025 passed by the A. C. J. M., Court No. 10, Azamgarh in Complaint Case No. 1301713 of 1996 (State Versus Subhash), under Sections 7/16 of Food Adulteration Act, P. S. - Nizamabad, district - Azamgarh, whereby the appellant has been convicted under Section 7 (1) read with 16 (1-A) (1) of Food Adulteration Act and sentenced with one year's simple imprisonment with a fine of Rs. 5000/-. along with default stipulations.

Learned AGA has raised a preliminary objection that an alternative efficacious remedy of filing an appeal is available to the appellant before the Court of concerned Sessions Judge.

Learned counsel for the appellant concedes to it and seeks to withdraw the present appeal with the liberty to approach the appropriate forum at the appropriate stage.

In view of the above, the present appeal is dismissed as withdrawn with the liberty aforesaid.
