The Writ Court has passed the following order on 31.10.2024:-

“ 1. Heard learned counsel for the petitioners.

2. Present petition has been filed with following prayer:-

"It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to expedite the execution proceeding Case No. 12/98 through Misc. Case No. 195/2023 (Chandra Dev Dubey Vs. Chandrapati Dubey and others) pending before Civil Judge (J.D.), Bansgaon, Gorakhpur, otherwise applicant shall suffer irreparable loss and injury."

3. Learned counsel for petitioners submitted that aforesaid case is pending since long, therefore, a direction may be issued to decide the same at the earliest.

4. In the facts and circumstances of the case, the present petition is disposed of with direction to Civil Judge (J.D.), Bansgaon, Gorakhpur to decide Case No. 12/98 through Misc. Case No. 195/2023 in accordance with law, if possible within a period of six months from the date of production of certified copy of this order after providing opportunity of hearing to all concerned and without granting any unnecessary adjournment to either of the parties.”

It has been submitted that, till date, aforesaid proceeding has not been decided in compliance of the order passed by this Court.

Registrar (Compliance) is hereby directed to communicate this order to the authority/court concerned to enable him submit his report on or before the next date fixed i.e. 16.03.2026.

Learned counsel for the applicant is directed to serve a photostat copy of the instant contempt application in the office of the Registrar
