Heard Sri Sharad Pathak, learned counsel for the applicant and Sri Amrendra Singh, learned Standing Counsel appearing for respondent.

The present contempt application is filed with the prayer that the respondent has not complied with the order dated 29.01.2014 passed by this Court in Writ Petition No.6659 (S/S) of 2012.

Learned counsel for the applicant submitted that the applicant had worked from 2011 up to the year 2016 but the salary was not paid to her.

From the perusal of record, it is evident that present contempt application is pending since 2016. As the affidavit of compliance has already been filed by Sri Ravi Shanker, District Inspector of Schools, Sultanpur on 21.05.2025 in which it has been stated that the petitioner did not work in the institution from 2011 up to 2016 and in this regard a letter was given of the joint signature of Manager as well as Principal of the institution dated 16.05.2025 addressed to the District Inspector of Schools, Sultanpur. It is also evident from the perusal of affidavit of compliance that salary has already been paid to the petitioner since 2016 up to 19.08.2020 and thereafter one Mr. Anil Kumar Shukla, a selected teacher, was allowed to join the institution and thereafter salary is being paid to him.

Considering the submissions of learned counsel for the parties and going through the contents of order of writ court as well as affidavit of compliance filed by District Inspector of Schools, Sultanpur it is well settled that disputed questions of fact cannot be adjudicated by the Contempt Court therefore, this court is of the view that after joining of the selected candidate, namely, Sri Anil Kumar Shukla, no contempt is made out.

Accordingly, the contempt application is hereby dismissed . However, it is open to the applicant to take appropriate remedy, if she is feeling aggrieved with the action of the authority as well as the Management in relation to the payment of salary since 2011 up to the year 2016.
