This bail application under Section 483 B.N.S.S. has been moved on behalf of accused-applicant, Umesh, seeking enlargement on bail in Case Crime No. 115 of 2011, under Section 272 and 273 of the Indian Penal Code, Police Station Kotwali Dehat, DistrictEtah.
Learned counsel for the applicant argued that the accusedapplicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 16.12.2024. In the aforesaid case the applicant was granted bail by the Court below on 05.04.2011. Thereafter C.J.M. Etah took cognizance vide order dated 16.05.2012 and summoned the applicant and other coaccused persons thereafter the applicant appeared before the Court on several dates fixed by the Court concerned but thereafter due to illness of his father the applicant was not able to attend the Court below on several dates. The trial Court has issued Non Bailable Warrant against the applicant vide order dated 17.07.2024. The applicant has surrendered before the court concerned and the applicant was sent to prison. Applicant is in jail since more than three months. Criminal history of one case has been explained in the affidavit filed in support of bail application and there is no likelihood of his fleeing from course of justice or tampering with evidence in case of release on bail; hence, bail has been prayed for.
