वतर्मान दािण्डक प्रकीणर् जमानत प्राथर्ना पत्र आवेदक की ओर से मु०अ०सं० 796/2025, अन्तगर्त धारा 318(4), 69, 89, 115(2), 351(3), 352 भारतीय न्याय संिहत , थाना इज्जतनगर , िजला बरेली में जमानत पर मुक्त करने हेतु प्रस्तुत िकया गया है।

आवेदक के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधवक्ता को सुना तथा पत्रावली का पिरशीलन िकया।

आवेदक के िवद्वान अिधवक्ता ने तकर् प्रस्तुत िकया िक आवेदक को इस प्रकरण में गलत एवं फजीर् ढंग से झूठा फंसाया गया है , उसने किथत अपराध कािरत नहीं िकया है। प्रासंिगक तथ्य यह है िक किथत पीिड़ता के बयानों तथा प्रथम सूचना िरपोटर् के अवलोकन से यह स्पष्ट होता है िक यह संपूणर् प्रकरण स्वेच्छा का िवषय है, क्योंिक सूचनाकत्रीर् िववािहत मिहला है तथा उसका पित उसे लगभग आठ वषर् पूवर् छोड़ चुका है। सूचनाकत्रीर् प्रारम्भ से ही इस तथ्य से अवगत थी िक आवेदक धमर् से मुिस्लम समुदाय का है, िहन्दू नहीं, तथा वह यह भी जानती थी िक वह िववािहत है और उसके दो बच्चे हैं। प्राथिमकी दजर् होने से लगभग आठ माह पूवर् सूचनाकत्रीर् के खाते में कुछ धनरािश स्थानांतिरत की गयी थी और यह िवश्वास करना असंभव है िक कोई व्यिक्त िबना दूसरे व्यिक्त का नाम जाने उसके खाते में धनरािश भेजे। संपूणर् प्रथम सूचना िरपोटर् में किथत अपराध की ितिथ का िकसी प्रकार से उल्लेख नहीं िकया गया है, मात्र एक ही बार में धमर् िछपाकर िववाह करने, उसके उपरांत वीिडयो बनाने तथा जान से मारने एवं वीिडयो वायरल करने की धमकी देने का आरोप लगाया गया है। आवेदक द्वारा किथत पीिड़ता का कोई अश्लील वीिडयो तैयार नहीं िकया गया है, बिल्क कोई भी वीिडयो अिस्तत्व में ही नहीं है। केवल यह कह देना िक अश्लील वीिडयो बनाया गया था, आवेदक को केवल संशय के आधार पर दोषी िसद्ध नहीं करता। प्रथम सूचना िरपोटर् में लगाए गए आरोपों के अनुरूप आवेदक द्वारा कोई अपराध

कािरत नहीं िकया गया है। यहाँ तक िक पीिड़ता की िचिकत्सकीय (मेिडको–लीगल) जाँच िरपोटर् के अवलोकन से भी कोई असामान्य तथ्य प्राप्त नहीं हुआ है तथा जीिवत या मृत िकसी भी प्रकार के शुक्राणु नहीं पाए गए हैं। इससे आवेदक के िवरूद्ध उपरोक्त धाराओं का अपराध नहीं बन रहा है। इसिलए, आवेदक जमानत पर मुक्त िकये जाने योग्य है। पुनः उनका कथन है िक आवेदक की ओर से यह आश्वासन िदया गया है िक वह कानून की प्रिक्रया में सहयोग करने के िलए तैयार है और जब भी आवश्यकता होगी वह ईमानदारी से अदालत के समक्ष खुद को उपलब्ध कराएगा और उन सभी शतोर्ं को स्वीकार करने के िलए भी तैयार है जो न्यायालय उस पर अिधरोिपत करेगी। आवेदक िनदोर्ष है तथा वह इस प्रकरण में िद० 29.08.2025 से कारागार में िनरुद्ध है। इसिलए , आवेदक को जमानत पर छोड़ िदया जाय।

िवद्वान अपर शासकीय अिधवक्ता ने अिभयुक्त के जमानत का प्रबल िवरोध करते हुए तकर् प्रस्तुत िकया िक अिभयुक्त द्वारा कािरत अपराध स ं ज्ञेय एवं गंभीर प्रकृित का है , इसिलए अिभयुक्त को जमानत पर न छोड़ा जाय।

उभय पक्ष के िवद्वान अिधवक्ता के तकोर्ं के पिरप्रेक्ष्य एवं पत्रावली पर उपलब्ध सारवान तथ्यों एवं पिरिस्थितयों का समग्र रूप से अवलोकन करने के बाद , सबूतों की प्रकृित और िकसी भी ठोस िवरोधात्मक सामग्री की अनुपिस्थित एवं उपलब्ध सामग्री से छेड़छाड़ की संभावना न होने के तथ्य को देखते हुए मेरी राय में आवेदक को जमानत पर मुक्त करने का उपयुक्त आधार है।

अतः वाद के गुण - दोष पर िबना कोई िटप्पणी िकए हुए आवेदक को उपरोक्त विणत अपराध में संबंिधत न्यायालय की संतुिष्ट पर व्यिक्तगत बंध - पत्र एवं अिधक धनरािश के दो स्थानीय प्रितभू प्रस्तुत करने पर िनम्निलिखत शतोर्ं के साथ जमानत पर छोड़ िदया जाय।

आवेदक िववेचना या परीक्षण के दौरान अिभयोजन साक्ष्यों के साथ छेड़छाड़ नहीं करेगा।

आवेदक अिभयोजन सािक्षयों व पीिड़ता / िशकायतकतार् को डरायेगा / धमकायेगा नहीं।

आवेदक न्यायालय के आदेशों का पालन करेगा , वह परीक्षण के दौरान िबना कोई अनावश्यक स्थगन िलए िनयत ितिथ पर न्यायालय में उपिस्थत होगा तथा परीक्षण में ईमानदारी से सहयोग करेगा।

आवेदक जमानत पर िरहा होने के बाद जमानत की स्वतंत्रता का दुरूपयोग नही करेगा और िकसी भी अपरािधक गितिविध में िलप्त नहीं होगा न कोई अपरािधक कृत्य करेगा।

आवेदक प्रत्यक्ष या अप्रत्यक्ष रूप से मामले के तथ्यों से पिरिचत िकसी भी व्यिक्त या पुिलस अिधकािरयों को कोई प्रलोभन या धमकी नहीं देगा न ही उनसे कोई वायदा करेगा
