1. Heard learned counsel for the applicant; learned AGA for the State and perused the material placed on record.

1. The instant bail application has been filed on behalf of the applicant Veeru Nishad with a prayer to release him on bail in Case Crime No. 134 of 2025, under Sections 331(4), 305, 317(2), 317(4) of BNS, Police Station Dubauliya, District Basti during pendency of trial.

1. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case due to ulterior motive. He further submits that the applicant is not named in the F.I.R., his name was surfaced during the course of investigation on the basis of false information given to the Investigating Officer. He further submits that as per the allegation contained in the F.I.R., some ornament and cash was said to be stolen by unknown person. He further submits that a concocted and false story has been set up by the prosecution whereas the applicant has not committed any offence as alleged in the F.I.R. He further submits that nothing incriminating has been recovered from the possession of the applicant. He further submits that false recovery of Rs. 7,200/- was said to be made from the possession of the accused applicant, however, neither there was any independent witness of the alleged recovery, nor any relevant evidence is on the record to substantiate the fact whether the aforesaid amount is related to the same incident or not.
