Sonu Ahirwar vs State of U.P.

The instant bail application has been filed on behalf of the applicant Sonu Ahirwar with a prayer to release him on bail in Case Crime No.206 of 2025, under Sections 61(2), 109(1) and 309(5) B.N.S., Police Station Kabrai, District Mahoba, during pendency of trial.

Learned counsel for the applicant submitted that F.I.R. has been registered as unknown. As per F.I.R. version, on 20.07.2025 when son of the informant Ramkishore aged about 40 years was sitting on the plank at the door of his shop holding the cash box, an unknown person came and shot him and ran way with the cash box. Some people chased him then due to fear he threw the cash box and ran away and all the cash kept in the box is safe. He further submitted that the applicant is not named in the F.I.R. and he has not committed any offence as alleged in the F.I.R. He has been falsely implicated in this case by the police showing the good work. He has been illegally and forcibly arrested from his house and the police shot in the foot of the applicant due to which he received firearm injury. Thereafter a false criminal case being Case Crime no.219 of 2025, under Section 109 B.N.S. and 3/25 Arms Act has been registered against the applicant in which he has been granted bail by the court below. The applicant is in jail since 28.07.2025. In case, the applicant is released on bail, he will not misuse the liberty of bail.

and submitted that the fact has been mentioned in the F.I.R. that unknown person caused firearm injury and committed robbery of box in which some amount was kept. During course of investigation involvement of the applicant was connected on the basis of the recovery of motorcycle which was said to be used in this incident. The injured Ramkishor alias Ramkripal in his statement recorded under Section 180 B.N.S.S. stated that one unknown person looted rokar box and caused firearm injury on his head. During course of investigation the motorcycle No.UP959133 was identified in the C.C.T.V. footage and the applicant himself was using motorcycle. On the date of arrest the complainant Ramswaroop, injured Ramkishor along other eye witnesses have identified the accused-applicant and stated that accused applicant has caused firearm injury on the injured. It is further submitted that in the medical report it has been clearly stated that fire bullet injury in right temporal region beside right eye was found.

Injury report of Ramkishor reads as under:

"Fire Bullet injury (foreign body) in Right Temporal Region. Beside Right Eye on 8.30 P.M. (Aprox) on 20.07.2025.

foreign Body (Bullet) removal on 22.07.2025."

From perusal of the injury report of injured Ramkisor, it appears that medical evidence corroborates the statements of the injured witness. The injured sustained grievous injury by means of firearm caused by the applicant. During course of investigation, illegal tamancha was also recovered from the possession of the applicant.

Without expressing any opinion on merits of the case and considering the submissions advanced by both the parties, nature of injury and the nature and gravity of the accusation, I find no good ground to grant bail to the applicant in the aforesaid case.

The bail application of the applicant is, accordingly, rejected.
