Learned counsel for the applicant submits that he is owner of Vehicle No. BR-28-GA-9617 and applicant has given his vehicle to Gopal Roadways on rent, however there is no reliable document regarding the fact that applicant has given his vehicle to Gopal Roadways on rent.

It is alleged in the F.I.R. that 403 quintal of wheat was misappropriated in this case.

Learned counsel for the applicant is directed to submit detail of contract between the owner and Gopal Roadways by means of an affidavit.
