1. Heard learned counsel for the applicant, learned AGA and perused the record.

None has appeared for respondent no.2.

2. The applicant seeks enlargement on bail in FIR No.351 of 2024, under Section 70(2), 351(2) BNS & Section 5g/6 of POCSO Act, P.S. Biswan, District Sitapur.

3. A complaint case was filed by the mother of the victim alleging that on 14.08.2024 the applicant had committed wrong on the daughter. Learned counsel for the applicant draws my attention to the FIR lodged by the victim narrating the incident which took place allegedly on 14.08.2024 at the same time, wherein allegations of beating were levelled. Even in the statement under Section 202 Cr.P.C., the victim alleged rape on the same date for which the FIR was lodged.

4. Learned AGA has opposed the bail application.

Considering the allegations in the complaint to be of similar date and similar time which are reflected in the FIR No.343 of 2024, a case for bail is made out, more so, when there is no material to corroborate the allegation, as such, the applicant who is in custody since 16.10.2025 is entitled to be enlarged on bail. In view thereof, the application is allowed .

6. Let the applicant Ajeet be released on bail in aforesaid FIR number on his furnishing a personal bond with two sureties of Rs.20,000/- each to the satisfaction of court concerned with the following conditions:

(a) The applicant shall execute a bond to undertake to attend the hearings;

¶19

(b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and

¶20

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
