Heard learned counsel for the applicants and learned A.G.A. for the State.

This application has been filed with the following prayer:-

"To quash the summoning order dated 13.09.2024 passed by learned Court of Additional Chief Judicial Magistrate- VII, Lucknow against the petitioners without application of judicial mind in Case Crime No. 109 of 2023 under sections 498-A, 323, 504 506 I.P.C. and 3/4 D.P. Act, P.S.Manaknagar, District- Lucknow in Case No. 409372 of 2024 (State versus Harjinder Singh & Another).

(ii) To quash the charge-sheet dated 31.07.2024 arising out of Case Crime No. 109 of 2023.

(iii) To quash the criminal proceedings of Case No. 409372 of 2024 (State versus Harjinder Singh and Another)."

Learned counsel for the applicants submits that marriage of the applicant no.1 was solemnized with the private respondent. Due to some trivial issues in matrimonial life of the applicant no.1 and the private respondent, the F.I.R. of the case in question was lodged on the basis of concocted facts. He further submits that the charge-sheet was submitted by the Investigating Officer without considering the evidence provided by the applicants. He next submits that on the basis of concocted facts, proceeding u/s 12 of D.V. Act has already been initiated by the private respondent. He also submits that

there is a possibility of amicable settlement in case the matter is sent to Mediation and Conciliation Centre of this Court.

Learned A.G.A. vehemently opposes the prayer of the applicants for quashing of the proceedings. He has no objection in case the matter is sent to Mediation and Conciliation Centre of this Court.

Considering the submissions of learned counsel for the parties and perusing the record, it is evident that genesis of the prosecution in question is matrimonial dispute, hence, possibility of settlement cannot be ruled out.

In view of above, the matter requires consideration.

Issue notice to the private respondent.

List this case on 12.01.2026.

¶23

On the next date, the applicant no.1 and the private respondent shall appear in person before this Court.

Station House Officer, Police Station- Manaknagar, District- Lucknow West (Commissionerate Lucknow) is directed to ensure presence of the private respondent, namely, Supreet Kaur w/o Harjinder Singh, d/o Sardar Brijpal Singh, r/o 559 Kha/379, New Shrinagar Near Haridarwar Gurudwara, Manaknagar, before this Court on the next date.

Until further order, the impugned proceedings shall remain stayed.

The applicant no.1 is directed to deposit amount of Rs. 50,000/- before Senior Registrar of this Court within a period of two weeks from today.

In case the aforesaid amount is not deposited by the applicant no.1 within the stipulated time, interim protection will not be available to the applicants.
