- Heard learned counsel for the applicants and learned A.G.A. for the State.

- It is submitted by learned counsel for applicants that the opposite party no.2/complainant is tenant in the shop of applicants and the impugned complaint has been lodged by the opposite party No.2/complainant making false and baseless allegations. Learned counsel has referred statement of complainant, recorded under Section 200 Cr.P.C., and statements of witnesses, recorded under Section 202 Cr.P.C., and submitted that no prima-facie case is made out against the applicants. The complainant has not sustained any injury. Referring to facts of the matter, it was submitted that no prima-facie case is made out against the applicants and that the impugned proceedings are malicious and thus, liable to be quashed.

- Issue notice to the opposite party no.2, returnable at an early date.

- Opposite party no.2 may file counter affidavit within four weeks.
