Heard learned Counsel for the applicants and learned learned A.G.A. for the State and perused the record.

The present petition has been filed for the following main relief:-

"WHEREFORE, it is most respectfully prayed that this Hon'ble court may graciously be pleased to quash/set-aside the entire proceeding of the complaint case no. 1971/2018 Range case no.29/2015-2016 (State Versus Dinesh @ Bhanga and others) arising out of Range Case no.29/2015-2016, U/s 2, 9, 27, 30, 31, 35(6), 51(1) of Wild Life Protection Act, 1971 and Section 26 Indian Forest Act, Range Bankati, District Kheri as well as summoning order dated 30.08.2016 passed by Chief Judicial Magistrate (State Vs. Dinesh alias Bhanga and others) contained in Annexure No.1 to this petition."

It appears from the record that in almost similar facts and circumstances as indicated in the present petition, this Court entertained the petition(s) bearing Application U/s 482 No. 9654 of 2023 (Lallan Singh and Others Versus State of U.P. and Others), Application U/s 482 No. 8264 of 2023 (Munna Lal Versus State of U.P. and Others), Application U/s 482 No. 8399 of 2023 (Moliram nad others Versus State of U.P. and Others) and protected the interest of applicants. This Court is of the view that the present petition preferred by the applicants on similar facts, is liable to be entertained. Accordingly, it is entertained.

Issue notice to opposite party no.2, returnable at an early date.

List alongwith Application U/s 482 No. 9654 of 2023 (Lallan Singh and Others Versus State of U.P. and Others), Application U/s 482 No. 8264 of 2023 (Munna Lal Versus State of U.P. and Others), Application U/s 482 No. 8399 of 2023 (Moliram nad others Versus State of U.P. and Others) in the month of January 2023 as fresh.

Steps be taken within seven working days.

Till the next date of listing, no coercive action shall be taken against the applicants.
