Applicant has flied this petitioner under Section 482 Code of Criminal Procedure,for quashing the charge sheet No.01 of 2019 as well as entire proceedings of Criminal Case No. 674 of 2019, titled State Vs. Dr. Shweta @ Shweta Singh, arising out of Case Crime No. 405 of 2018, under Sections 323, 504, 506, 427 I.P.C., Police Station Indira Nagar, District Lucknow.
This petition was filed in August, 2019 and the same is still pending at the admission stage and even notice has not been issued to the other side. However, there is no interim stay in favour of the applicant, much less to stay the proceedings before the trial court.
Application has been pending for the last six years and by now, the trial must have progressed, therefore, the alleged cause of action seemingly is rendered infructuous.
The application is dismissed
