It is submitted by learned counsel for applicants that there is matrimonial dispute between the parties. The applicants have filed an application for maintenance under Section 125 Cr.P.C. in the court of Principal Judge, Family Court, Shamli at Kairana, which was registered as Case No. 32 of 2021. The application under Section 125 Cr.P.C. was allowed by Principal Judge, Family Court, Shamli at Kairana vide judgment and order dated 10.11.2023 awarding maintenance @ Rs. 5,000/- per month in favour of applicant no. 1, who is wife of opposite party no. 2 and Rs. 2,000/per month to applicant no. 2 who is minor daughter of opposite party no. 2. It is further submitted that the order dated 10.11.2023 had been challenged by opposite party no. 2 by filing Criminal Revision No. 6632 of 2023 before this Court and the coordinate Bench of this Court vide order dated 01.02.2024 had issued notices to the applicants and had not passed any interim order in favour of opposite party no. 2. It is stated in para no. 12 to the affidavit filed in support of present 482 application that the applicants had already filed counter affidavit in the aforesaid criminal revision. Lastly, it is submitted that till date no interim protection has been granted by this court in favour of opposite party no. 2. The applicants have filed an application under Section 128 Cr.P.C. for recovery of maintenance amount which was registered as Misc. Case No. 122 of 2024 (Smt. Swati Sharma and another vs. Anil Sharma) but till date nothing has been done and no amount has been recovered from opposite party no. 2. The matter is pending
